2014 Update to the Kansas No-Call Act

In 2002 the Kansas Legislature passed the Kansas No-Call Act. This was actually one year before similar federal legislation was passed nationally. Some of the provisions passed in Kansas' original 2002 law are:

  • Telephone solicitors must consult the Kansas no-call list quarterly and delete any added numbers
  • Solicitors have 60 days to remove any additional numbers from their calling lists from the time they receive the quarterly updates
  • Consumers are required to receive clear notice that their calls may not immediately decrease for up to 90 days because of the quarterly updates
  • Any fines recovered from violations are to be paid to the Kansas Attorney General for enforcement use
  • The Kansas Attorney General may promulgate rules and regulations to carry out the  No-Call Act


The 2014 legislation made several adjustments to the existing law to make it more up-to-date, and to provide uniformity with the federal law. A significant change for consumers is that cell phone numbers are now covered under the Kansas law. In addition, solicitors must now update their no-call lists every 30 days, instead of the previous period of three months. The amendments also clarify that written request is sufficient for telephone solicitors to honor, and that they must honor the request for five years from that date.

In addition, the Kansas no-call list established in 2002 is now deferred to the national no-call list. When Kansas consumers wish to add their names to the Kansas no-call list, the Kansas Attorney General will direct them to contact the Federal Trade Commission to add their name to the national no-call list. However, because the Kansas No-Call Act is still Kansas law, the Kansas Attorney General is still authorized to prosecute Kansas violations of the national no-call list on behalf of Kansas citizens.

The Kansas No-Call Act can be found in the Kansas Statutes at KSA 50-670 and 50-670a, although it will be several months before the amended statutes are published with the 2014 additions; this is the law as it existed from 2002 to June 30, 2014:
